Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service, including a Customer Account or a Driver Account, as applicable.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Application refers to QUICKFILL, the software program provided by the Company, including the customer app, the driver app, and the Admin Panel.
- Business for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.
- CCPA and/or CPRA refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to Quick Fill LLC, 3100 Jamaica street Sarasota Florida 34231.
- Consumer for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
- Country refers to: Florida, United States.
- Customer means an individual who registers a Customer Account to request Fuel deliveries through the Application.
- Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- Driver means an individual who registers and is approved by the Company as a Driver Account holder to accept and fulfill Fuel delivery jobs through the Application.
- Personal Data (or "Personal Information") is any information that relates to an identified or identifiable individual. For the purposes of the CCPA/CPRA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You. We use "Personal Data" and "Personal Information" interchangeably unless a law uses a specific term.
- Service refers to the Application, together with the on-demand Fuel delivery service, driver-dispatch functionality, and Admin Panel that support it.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to process payments, to conduct background checks on Drivers, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit, or an order's status timeline).
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable, including both Customers and Drivers unless the context requires otherwise.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number, used to send You an OTP for account verification
- Delivery address, state, ZIP/postal code, city
- Vehicle information (such as make, model, year, and fuel type)
- Payment card or Wallet information, processed through Our payment processor
Additional Information Collected from Drivers
If You register as a Driver, We additionally collect:
- Driver's license number and expiration date
- Vehicle registration and proof of insurance
- Background check results, where permitted by applicable law and with Your consent
- Banking or payout account details, used to pay Driver earnings
- Real-time location data while online and during active deliveries
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages or screens of our Service that You visit, the time and date of Your visit, the time spent on those pages or screens, order and delivery status history, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
Information Collected while Using the Application
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
- Information regarding Your precise, real-time location, used to detect Your current position for delivery, to dispatch and route Drivers, and to power live order tracking
- Pictures and other information from Your Device's camera and photo library, such as proof-of-delivery photos taken by a Driver, or vehicle photos
We use this information to provide features of Our Service, such as dispatching the nearest available Driver, estimating delivery times, and confirming completed deliveries, and to improve and customize Our Service.
Location Access Notice: You can enable or disable access to location information at any time through Your Device settings. Please note that disabling location access will prevent You from placing or fulfilling orders, since location data is necessary to operate the Service.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service: including to monitor the usage of our Service, dispatch orders, and track deliveries in real time.
- To manage Your Account: to manage Your registration as a Customer or Driver.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the Fuel or services You have purchased.
- To contact You: by email, telephone calls, SMS, or push notifications including OTPs, order status updates, driver-arrival alerts, receipts, and security updates.
- To verify Your identity and eligibility: age verification, parental/guardian consent where applicable, and driver background-check verification.
- To process payments: to charge Your Wallet payment method for orders and Subscriptions, and to pay Driver earnings.
- To provide You with news and special offers: general information about other goods, services and events which We offer.
- To manage Your requests: To attend and manage Support inquiries and delivery disputes.
- To ensure safety and compliance: to monitor for fraud, verify safe delivery practices, and enforce Terms and Conditions.
Sharing Your Personal Data
We may share Your Personal Data in the following situations:
- With Drivers: Limited Customer info (name, delivery location, vehicle) with assigned Driver.
- With Service Providers: Third-party processors for payment processing, background checks, analytics, and messaging.
- For business transfers: During merger, sale of Company assets, or financing transactions.
- With Affiliates & Business Partners: With strict privacy adherence.
- With Your consent: For any other purpose disclosed at the time of collection.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. Retained periods for categories of data include:
- User Accounts: Duration of account relationship plus up to 24 months post-closure.
- Order and Delivery Data: Retained for up to 7 years to comply with tax, accounting, and fuel-delivery recordkeeping obligations.
- Proof-of-delivery photos: Up to 24 months.
- Driver Verification Data: Active status duration plus up to 24 months post-deactivation.
- GPS Location Data: Up to 24 months for dispatch, route optimization, safety monitoring, and dispute resolution.
- Customer Support & Chat Data: Up to 24 months.
- Usage Data & Server Logs: Up to 24 months for security and analytics.
Delete Your Personal Data
You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.
You may update, amend, or delete Your information at any time by signing in to Your Account and managing settings, or contacting Us directly.
CCPA/CPRA Privacy Notice (California Privacy Rights)
This privacy notice section for California residents supplements the information contained in Our Privacy Policy and applies solely to California residents.
